Terms of service

These terms are an agreement between you and TORRIN PEEDO-KAY, a sole trader in Australia, ABN 20 803 629 001, trading as LeadSwarm (“we”, “us”). Our address for notices is support@leadswarm.io. They apply when you create an account or use the service. If you do not agree with them, do not use it.
What LeadSwarm does
LeadSwarm discovers businesses through search results, fetches their public websites, and scores them so you can decide who to approach first. The scores are heuristics computed from observable signals. They are an aid to judgement, not a prediction, a guarantee, or professional advice.
What LeadSwarm does not do
- It does not send email or messages on your behalf.
- It does not verify that a business wants to be contacted.
- It does not guarantee that discovered contact details are current, correct or complete.
- It does not guarantee any particular result from your outreach.
- It does not use a language model. Pitch and email drafts are composed from templates over the signals we detected, which is why the same prospect always produces the same draft.
Your account
You are responsible for keeping your credentials secure and for everything done under your account. Tell us promptly if you believe your account has been accessed by someone else. One account is for one customer; do not share access with people outside your organisation.
You must be at least 18, and if you are agreeing to these terms for a business you must have authority to bind it.
Acceptable use
You agree not to:
- use LeadSwarm to send unsolicited commercial messages in breach of the Australian Spam Act 2003, the US CAN-SPAM Act, the EU e-privacy rules and the GDPR, the UK Privacy and Electronic Communications Regulations, or the equivalent law in your market;
- use it to harass, threaten, defraud or discriminate against anyone;
- resell or redistribute the discovered data as a contact database;
- attempt to circumvent usage allowances, or automate the interface to exceed them;
- attempt to access another customer's data, or probe the service for vulnerabilities without our written permission;
- use the service to build a competing product.
Your obligations when you contact a business we surface
Finding a business through LeadSwarm is not consent to contact it, and we give you none. You are the sender, and every obligation that attaches to sending is yours:
- Australia — under the Spam Act 2003 a commercial electronic message needs consent (express or inferred), must accurately identify you, and must carry a working unsubscribe facility that you honour within five working days.
- United States — under CAN-SPAM your message needs accurate headers and subject line, your physical postal address, a clear opt-out, and opt-outs honoured within ten business days.
- EEA and UK — you need a lawful basis under the GDPR for using someone's contact details, you must give them the privacy notice the GDPR requires when you first contact them, and the e-privacy rules restrict unsolicited electronic marketing, in some countries including to businesses.
You are the controller of the data once you export it or act on it. If a person asks you to stop, stop.
Plans, billing and price changes
Plans and their allowances are published on the pricing section. Paid plans are billed monthly in advance, in Australian dollars, through Stripe. Allowances reset at the start of each billing period and do not roll over.
We are not registered for GST, so no GST is charged and the listed amount is the total payable. If we become registered we will tell you before the change affects you, as set out below. Any tax your own country imposes on the purchase is yours to account for.
If a payment fails we will retry it and email you. Your access continues during that retry window. If payment ultimately fails, the account returns to the Free allowance. We do not delete your data because of a failed payment.
We may change prices. If we do, we will give you at least 30 days' notice by email before the change affects you, and you can cancel before it takes effect.
Cancellation and refunds
You can change or cancel your plan at any time from the billing screen in the app. Cancelling stops future charges and returns you to the Free plan at the end of the period you have already paid for; you keep your data.
Nothing in this section limits the consumer guarantees in the Australian Consumer Law, and nothing in these terms excludes, restricts or modifies them — they cannot lawfully be excluded. Under those guarantees, if the service has a major failure you are entitled to cancel and get a refund of the unused part of what you paid, or to compensation for the drop in value; if the failure is not major, we may choose to fix the problem in a reasonable time, and if we do not, you can cancel and get a refund. You are also entitled to compensation for any other reasonably foreseeable loss or damage.
Outside those guarantees, our voluntary position is:
- We do not routinely pro-rate a refund for a partly used month; you keep the plan until the end of the period you paid for.
- If you are charged in error, or a renewal you had already cancelled goes through, email us and we refund it in full.
- If the service was substantially unavailable for a meaningful part of a billing period, ask us and we will refund or credit that period. We would rather do that than argue about it.
Refund requests go to support@leadswarm.io and are answered within one business day. Refunds are made to the original payment method through Stripe.
Your data
Your searches, prospects, campaigns and notes belong to you. You can export them at any time as CSV or JSON, and you can download a complete JSON copy of everything we hold about you from Settings → Account. We handle them as described in the privacy policy.
You are responsible for having a lawful basis to hold and use the business contact details you gather with LeadSwarm, and for responding to the people whose details they are.
Availability
We do not offer a service level agreement and we do not promise uninterrupted service. We aim to keep LeadSwarm running and to give notice of planned maintenance where we can. Discovery depends on a third-party search provider; if that provider is unavailable, changes its terms, or changes its pricing, some functionality may be degraded, limited or withdrawn. If we withdraw something you were paying for, tell us and we will refund or credit the affected period.
Liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Subject to that, LeadSwarm is provided as-is, and our total liability to you for any claim is limited to the amount you paid us in the twelve months before the claim. We are not liable for lost profits, lost business or indirect loss.
You are liable for your own outreach. If someone brings a claim against us because of messages you sent or how you used data you gathered through LeadSwarm, you will cover our reasonable costs of dealing with it.
Ending the agreement
You can close your account at any time from Settings → Account. That cancels your subscription and permanently erases your workspace, so export anything you want to keep first — the same screen offers a full JSON copy. Exactly what is erased is set out in the privacy policy.
We may suspend or close an account that breaches these terms, and will tell you why unless we are legally prevented from doing so. If we close your account for a reason other than your breach, we refund the unused part of the period you have paid for.
Changes to these terms
We may update these terms. If a change materially affects you, we will notify you by email at least 30 days before it takes effect, and you can cancel before then if you do not accept it.
Governing law
These terms are governed by the laws of Queensland, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Queensland.
If you are buying from outside Australia as a consumer, this clause does not deprive you of the protection of any mandatory consumer law of the country where you live, and you may bring proceedings in your local courts where that law gives you the right to.
